Michael E. McCabe

Michael E. McCabe, Jr. is a member of Funk & Bolton, P.A., resident in the firm’s Baltimore office. He concentrates his practice in complex commercial litigation in federal court. He represents life, health, and disability insurers in state and federal court and before administrative tribunals. He also represents law firms in matters involving legal malpractice and practitioners in disciplinary proceedings in Maryland, Virginia, and the District of Columbia.

Mr. McCabe has over 19 years of litigation experience in federal and state trial and appellate courts. From 1999 until 2011, Mr. McCabe was a litigation partner at Oblon, Spivak, McClelland, Maier & Neustadt, P.C., an intellectual property firm in Alexandria, Virginia. In 2011, he was named to Best Lawyers in America®. He is a skilled intellectual property attorney with 15 years of experience in patent litigation and related client counseling and opinions. Mr. McCabe has represented large and mid-sized foreign and domestic corporate clients in a broad range of intellectual property disputes involving patents, trademark, unfair competition, and trade dress rights. In addition to litigating cases, Mr. McCabe counsels his clients on risk management, pre- and post-litigation strategies, management of parallel ongoing proceedings, litigation avoidance, and licensing.

From 1992 until 1995, Mr. McCabe was a litigation associate at Shapiro & Olander in Baltimore, Maryland, where he represented clients in commercial and insurance litigation matters in federal and state court. Mr. McCabe was previously a litigation partner in the Washington, D.C. office of McDermott, Will & Emery.

Mr. McCabe has lectured and published extensively on issues relating to litigation, risk management, and legal ethics. In 2011, Mr. McCabe was elected by the Virginia State Bar to a three-year term on the Fourth District Committee on Lawyer Discipline. He is an officer in the Giles S. Rich American Inn of Court and the Intellectual Property Section of the Maryland State Bar Association. From 2007-2010, Mr. McCabe was an adjunct professor of law at George Mason University School of Law. Mr. McCabe currently serves as a faculty member for the Virginia State Bar’s Harry L. Carrico Professionalism Course.

Mr. McCabe received his J.D. magna cum laude in 1992 from the University of Baltimore School of Law, where he was a member of the Law Review and the National Moot Court team. In 1985, he earned a Bachelor of Science degree in Mechanical Engineering from the University of Maryland College Park. Before entering the practice of law, Mr. McCabe was an engineer at the National Aeronautics and Space Administration, Goddard Space Flight Center, in Greenbelt, Maryland.
